The project

With the Right to Clean Air project (LIFE15 GIE/DE/795 LEGAL ACTIONS), we are endeavouring to significantly improve air quality in Europe. Deutsche Umwelthilfe e.V. (Environmental Action Germany, DUH) and the Frank Bold Society (FBS) jointly promote air pollution control measures in different source areas and support legal action at European and national level.

We fight for clean air

In the past DUH has repeatedly sued the implementation of air quality measures. Nevertheless the air pollution with NO2 and fine particles in cities are one of the central challenges. You will find more information in German about the legal background, the air pollution and possible measures with this Background information.

Written Judgement Federal Administrative Court

On 27 February 2018, the Federal Administrative Court (Bundesverwaltungsgericht - BVerwG) in Leipzig issued a decision in principle regarding the lawsuits filed by Deutsche Umwelthilfe für Saubere Luft in Düsseldorf and Stuttgart. The judges confirmed the legal opinion of the DUH that diesel driving bans are already possible today in compliance with the principle of proportionality. The two judgments are available for download here.
